1. Acceptance of Terms

By renting or using a storage unit at Labrador West Self Storage (“Labrador West Self Storage,” “we,” “us,” or “our”), the customer (“you” or “your”) agrees to comply with these Terms & Conditions, the terms of the applicable rental agreement, and all applicable laws and regulations. Your rental agreement, together with these Terms & Conditions, forms the agreement between you and Labrador West Self Storage.

2. Storage Unit Use

Storage units are provided for the storage of lawful personal, household, commercial, or other approved property. You agree that:

  • You will use the unit only for lawful purposes.
  • You will not use the storage unit as a residence, workplace, or sleeping accommodation.
  • You will not conduct business activities from the facility without prior written approval.
  • You will not store property belonging to another person without authorization.
  • You will keep the storage unit clean and in good condition.
  • You will not make alterations, installations, or modifications to the storage unit.
  • You will not damage the unit, buildings, gates, fencing, security equipment, or other property belonging to Labrador West Self Storage.

3. Prohibited Items

You must not store any illegal, hazardous, dangerous, explosive, flammable, toxic, corrosive, radioactive, or environmentally harmful materials. Prohibited items include, but are not limited to:

  • Illegal drugs or substances
  • Explosives, fireworks, or ammunition
  • Flammable fuels or liquids, except where expressly permitted by law and the rental agreement
  • Hazardous chemicals or toxic materials
  • Perishable food or materials likely to attract pests
  • Live animals
  • Stolen property or property obtained through unlawful activity
  • Any item prohibited by applicable law or reasonably determined by Labrador West Self Storage to create a safety or security risk

Labrador West Self Storage may require the immediate removal of prohibited items and may take any action permitted by law where prohibited materials are discovered.

4. Customer Responsibility for Property

You are solely responsible for the property stored in your unit. Labrador West Self Storage does not inspect, supervise, or assume responsibility for the contents of your storage unit. You are responsible for determining whether your belongings require insurance and for obtaining appropriate insurance coverage. Customers are strongly encouraged to maintain adequate insurance for the full replacement value of their stored property.

5. Risk of Loss or Damage

To the extent permitted by applicable law and the rental agreement, Labrador West Self Storage is not responsible for loss of or damage to stored property arising from theft, fire, water, weather, pests, mold, mildew, condensation, temperature changes, power failure, acts of nature, or other causes beyond our reasonable control. Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

6. Access to the Facility

Customers must follow all posted facility rules and access procedures. Access hours may be changed from time to time for maintenance, weather, safety, security, or other operational reasons. Customers must not provide unauthorized persons with access credentials, gate codes, keys, or other access devices. You are responsible for securing your unit after each visit and must ensure that doors, gates, and locks are properly secured.

7. Locks and Security

Unless otherwise agreed, customers are responsible for providing and maintaining an appropriate lock for their storage unit. You must not duplicate, share, or misuse access codes, keys, or security credentials. If you lose a key or access device, you must notify Labrador West Self Storage as soon as reasonably possible.

8. Rent and Other Charges

Rent and other applicable charges are due according to the rental agreement. Failure to make payment when due may result in late fees, restricted access, termination of the rental agreement, and/or other remedies available to Labrador West Self Storage under the rental agreement and applicable law.

9. Default

If you fail to comply with the rental agreement or these Terms & Conditions, including failure to pay rent or other charges, Labrador West Self Storage may exercise any rights and remedies available under the rental agreement and applicable law. Where permitted by law, remedies may include restricting access to the unit, terminating the rental agreement, and dealing with stored property in accordance with applicable laws governing self-storage facilities, liens, and default.

10. Customer Information

You agree to provide accurate and current contact information, including your name, mailing address, telephone number, and email address where applicable. You are responsible for notifying Labrador West Self Storage of changes to your contact information.

11. Inspection and Access

Labrador West Self Storage will not routinely inspect the contents of a storage unit. However, we may enter or inspect a unit when reasonably necessary for maintenance, repairs, safety, emergencies, suspected prohibited activity, suspected damage, or where otherwise permitted or required by law. Where legally required, reasonable notice will be provided.

12. Cleanliness and Damage

Customers must leave the storage unit clean and free of garbage, debris, or personal property when the rental ends. You may be responsible for reasonable costs associated with repairing damage caused by you, your guests, contractors, or anyone you allow onto the property.

13. Vehicles

Vehicles, trailers, equipment, or other items may only be stored in areas specifically designated for such use and subject to any additional terms established by Labrador West Self Storage. All stored vehicles must comply with applicable laws and facility requirements.

14. Changes to These Terms

Labrador West Self Storage may update these Terms & Conditions from time to time. Where appropriate, customers will be provided notice of material changes. Continued use of the facility after applicable changes take effect constitutes acceptance of the updated terms, subject to applicable law.

15. Governing Law

These Terms & Conditions are governed by the laws applicable in the Province of Newfoundland and Labrador and the applicable laws of Canada.

17. Entire Agreement

These Terms & Conditions are intended to be read together with the customer’s rental agreement. If there is a conflict between these Terms & Conditions and a signed rental agreement, the applicable rental agreement will govern to the extent permitted by law. Nothing in these Terms & Conditions is intended to waive or limit rights or protections that cannot legally be waived or limited.
